Default KA splits pot with pair of deuces? Any circumstances?

2 players Player 1 holds AcKc Player 2 holds 2h 2d River is 8d 8h 9d 9h 3c Player 1 claims rules say that AK splits pot with 22 under these circumstances. Any help?

AK wins- his 5 card hand is two pair (9's and 8's) with A kicker. 22 has two pair (9's and 8's) with 3 kicker. AK outkicked 22.

Always remember that the best 5 card hand counts:

    player 1: 8d 8h 9d 9h 3c
    player 2: 8d 8h 9d 9h Ac

    Player 2 wins.

This sounds like a great drunken argument to have with someone who just wont accept facts at 3am in a home game!

How about, "I'm not doing side pots, cards up". That was a sort of ongoing one at our home game for a few weeks
