    Wow, this is worse than the person that sued (and won an out-of-court settlement) for being served coffee that was (gasp!) hot, instead of lukewarm.

    And there's much more to be concerned about regarding the state of America than trivial lawsuits.

    Who cares?

    She isn't going to win. She is just hoping that the company will settle out of court to avoid the negative media and financial costs of fighting this in court.

    Perhaps the US government should force all matters of this nature to go to court, and reimburse the party that wins. That way people will actual have to sue for things they can either 1. prove, 2. things that break the law.. or gasp 3. both

    While I agree that there are a lot of fairly-frivolous lawsuits out there, keep in mind this is a class-action suit more about deceptive labeling than the individual's "damages" -- which, btw, I don't think there would be any unless she actually ate some of that shit.

    It 's b.s. But unfortunely 2% of amerians are looking for that free meal ticket at someone else's expense. Just look at how overly abused the wellfare system is. I'll admit, I'm a lazy american (and love it! ), but most of use have some sense integrity. Unfortunately, these bad apples and their lawsuits always make the news. You just don't hear about the other 98% of americans that continue the daily grind with some integrity.

    And as far as taste goes, that is pretty subjective. If it doesn't taste like what people want it to taste like, then they will not continue buying it... end of story.

    I mean where does it end? Is someone eventually going to sue MLB becaues the World Series and the "World Champions" are not truely world champions since it is only played in the Americas?

    And all the ingrdiants are printed right on the label! They are not hidding anything.

    yes SunnyDelight could and should be sued if they called a product "orange juice" and it contained no orange juice.

    The question at issue is whether the name "guacamole" implies that a product's primary ingredient is avocados. Or, at the very least, whether more than 3% of it will be...

    Also, after an appeal the woman's damages were reduced to her medical bills, which were around $14,000. If I remember the facts correctly, the burns left a scar on her genitals.

    About the suit though, if the case is about deceptive advertising, it's not about the product, it's about the attorney's fees.

    Well if it's supposed to be an "avacado-based" dip, then 2% may be stretching the point a bit.

    Still, since they have an ingredients list then I say buyer beware.


    I'm still trying to work out whether the guys who put "may contain traces of nut" on their peanut butter jars are very smart or very stupid...
