Default Gambling in non gambling states legally

Maybe this is the wrong forum but I'm curious about this.

In New Hampshire there is a restaraunt that has poker night...it's a $60 buyin and you get $50 worth of chips...$10 goes towards charity and you cash out at the end of the night. They have police officers on duty and it's a legit establishment. How is this legal when they are trying to ban online poker?

Playing online poker has never been illegal.

In the UK it's the taking of a rake that breaks laws. If the house doesn't make a profit then it's not illegal - could it be the same in NH?

I'm pretty sure they are getting around it by saying it's for charity and donating a tiny bit of the money to some charity and then the bar or restaraunt just makes money because they've got 100 bodies in their establishment drinking on a wednesday that normally wouldn't be there.

I'm hoping to go up sometime soon and check it out...I have a couple of friends who go on a regular basis.
